Upsidia is operated by MyJobMag Limited (“we”, “us”, “our”). By creating an account or using Upsidia you agree to these terms. If you use Upsidia on behalf of a business, you confirm you are entitled to bind that business.
Upsidia provides tools for trades and local service businesses: quotes, invoicing, payments, bookings, customer records, reviews, messaging and related features; a free public business directory; and optional done-for-you marketing services. We add, change and remove features as the product develops.
Keep your login details secure and your account information accurate. You are responsible for what happens under your account. Tell us promptly through our contact page if you believe your account has been compromised.
Do not use Upsidia to break the law, to send spam or messages people have not agreed to receive, to infringe anyone’s rights, to upload malicious code, or to interfere with the service or other users. We may suspend or close accounts that do.
Everything you put into Upsidia stays yours. You give us the licence we need to store, process and display it in order to run the service. You are responsible for the data you hold about your customers, including having a lawful basis to contact them and honouring opt-outs. Our Privacy Policy explains how we handle personal data.
Upsidia has a free plan and paid plans, billed monthly or yearly through Stripe. Where a paid plan includes a trial, you can cancel before the trial ends and pay nothing. Subscriptions renew automatically until cancelled. When you cancel, your plan stays active until the end of the period you have paid for, and we do not refund partial periods except where the law requires it. If you buy through an app store, the store’s billing terms apply to the purchase. We will give you reasonable notice before any price increase takes effect for you.
Text messages and emails you send through Upsidia are your messages. You must have the right to contact the recipients, include anything the law requires, and respect opt-outs. Message credits and sending limits may apply depending on your plan.
Directory listings are free. You confirm the information in your listing is accurate and yours to publish. We may edit, decline or remove listings to keep the directory useful and lawful.
Marketing and other done-for-you services are scoped and agreed separately. Unless we agree otherwise in writing, those engagements are also governed by these terms. We work to a high standard, but we do not guarantee specific search rankings, lead volumes or business results.
We aim to keep Upsidia available and working well, and we maintain backups. The service is provided “as available”; we do not promise it will be uninterrupted or error free, and we may occasionally suspend it for maintenance or to protect it.
Nothing in these terms limits liability that cannot be limited under the law of England and Wales, including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for loss of profits, revenue or data, or for indirect losses, and our total liability in any 12 month period is limited to the fees you paid us in that period, or £100 if you have paid none.
You can close your account at any time. We can suspend or end your access if you seriously or repeatedly break these terms, and we will give you notice where it is reasonable to do so. On closure, our Privacy Policy governs what happens to your data.
We may update these terms as the service evolves. If a change is significant, we will tell you by email or in the product before it takes effect. If you keep using Upsidia after a change takes effect, the new terms apply.
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where mandatory consumer law in your country of residence gives you additional protection.
